Common Law Created And Refined By Judges In Legal System
When in a legal system any law is defined in a polished way it is called common law. A judge takes the examples of other cases to re-establish a law. The body of the precedent cases is known as the common law. When in future any party disagrees on the rule, the court can put the precedent of the past ruling in favor of its decision. If the court feels that the case is distinct from all previous cases, then it is considered as matter of first impression. Thereafter, the new decision becomes precedent, and will bind future courts under the principle of stare decisis.
