Child Support Periodic Care Payment Rule For Noncustodial Divorced Parents


Child support is the obligation by noncustodial parent to another custodial parent by periodically payment for caring as well as supporting the children from some relationship or marriage, which is annulled. It is made in the family law and policy of the government.

Child support in family law is there as part of marital separation, annulment, dissolution of a civil union, divorce, dissolution, and determination of parentage, which may add on to alimony as spousal support arrangements. There is a universal consensus of the child support and the parents’ responsibilities in providing such support.

The UN convention on the rights of the child has in 1992 has declared about bringing up and development of child and provide adequate standard of living for the development of children to be the common responsibility of both the parents. It is also a children’s fundamental human right as well. It also says that the main responsibility of providing this rests completely with the parents. The right to have child support is recognized by different international units like The Hague Conference, Council of Europe and the European Union.

The legal basis of child support is that both the parents are compelled to support their own children, even if the child does not live with its biological parents. In separation case, the court permits one parent is provided custody and also can act as primary caregiver. Visitation by the non custodial parents is given by the court.

The other parent is obliged to pay some proportion of costs required for raising the child. One parent will also have to pay the other one if both of the parents act as custodial parents while sharing their child responsibilities. A parent having sole custody of children may have to pay the non custodial parent when the child is in the care of the other parent.

There is no need for proof of marriage for the parents and if the paternity or maternity is demonstrated, the court can order for child support. The principle of estoppel enables child support in which case a de facto parent in loco parentis for a significant time is enough to demonstrate permanent relationship of parents and children. The child support issue and visitation are decided in the divorce or paternity settlement. These two rights as well as obligations are completely different though and can be applied individually.
