5th Amendment United States Constitution


Amendment V or the 5th Amendment of the United States Constitution is a part of the Bill of Right which is associated to legal course of action. This amendment gives assurance of stem from English common law as set up in 1215 by Magna Carta. For an example, both grand juries and the phrase due process have been derived from their origin to the Magna Carta

The text 5th Amendment of the United States Constitution goes like- No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

The Grand juries of 5th Amendment of the United States Constitution return indictments in lots of criminal cases. These grand juries operate in closed deliberation proceedings and made of a jury of peers conversant with detailed instructions concerning the law by the judge. The legal proceedings of the grand juries do not abide by the variation of constitutional restrictions.

The exclusionary rule does not apply to evidence presented to a grand jury of 5th Amendment because this put a stop to evidence seized in breach of the Fourth Amendment from being introduced in court. When hearing takes place witnesses cannot have their attorneys present in grand jury rooms because they dont have the right for this. The grand jury indictment clause of this amendment is not included under the Fourteenth Amendment.

Under the 5th Amendment of United States Constitution it is thus presumable that the grand jury indictment clause has not been ruled applicable to the states. States can act with its own freedom to close down grand juries. There are many states who have in fact replaced them with preliminary hearings.

The 5th Amendment of United States Constitution shows that the infamy of a crime is settled on by the nature of the punishment and this may be a case of imposed opinion. Only in limited state of affairs indictments charged by grand juries may be amended by the tribunal. Those who are serving in the armed forces during wartime or peacetime are not protected by the grand jury clause of the Fifth Amendment.Wikipedia
